Our client was being sued by a former employee for an alleged work related injury. The allegation was of a foot injury preventing the person from walking more than a few feet without having to stop and rest. A possible address was provided and the fact that the individual had been seen near an unlicensed “bottle club”. Surveillance was conducted on the home and the club. The individual was observed at the club. The subject was followed and video-taped riding a bicycle and walking for over a mile through vacant lots, streets, sidewalks and up/down hills. This video evidence assisted in the dismissal of the claim against our client.
