We were retained by a criminal defense attorney who was representing a subject accused of a burglary with a person assaulted. Law enforcement reports indicated that two individuals, one our client, were at a residence visiting a friend. The friend became involved in a physical altercation with a neighbor. The fight was stopped by the two individuals. The neighbor and his relatives then alleged that the two individuals came to their residence, threatened them, pushed their way into the home, and battered the main aggressor in the earlier fight. This aggressor then armed himself with a handgun firing in what he claimed was self defense striking one of the two individuals. Law enforcement arrived and interviewed most of the individuals present. The interviews appeared to be focused on what the one group had indicated occurred. It was never determined exactly if entry was made into the residence and if the subject actually fired in self-defense. Our investigators interviewed the witnesses identified by law enforcement as well as many others. All agreed there had been an earlier fight. The main aggressor had gone to obtain a handgun from his residence. The two individuals who had separated the fight went to the residence hoping to deter the aggressor from exiting with a handgun. This lead to a physical altercation on the porch and the shooting. This information assisted the defense attorney in obtaining a mutually agreeable plea. The subject was facing a life felony and is now serving 2 years of probation for a far lesser crime.
